Terms and conditions
The conditions under which Woodmobiel supplies products via this webshop.
1. General
1.1 These general terms and conditions apply to all offers from Woodmobiel. The conditions are accessible to everyone and included on the Woodmobiel website. Upon request, we will send you a written copy.
1.2 By placing an order, you indicate that you agree to the delivery and payment terms and conditions. Woodmobiel reserves the right to change its delivery and/or payment terms after the expiry of the term.
1.3 Unless otherwise agreed in writing, Woodmobiel does not recognize the general or specific terms or conditions of third parties.
1.4 Woodmobiel guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.
2. Delivery
2.1 Delivery takes place as long as stocks last.
2.2 Within the framework of the rules of distance selling, Woodmobiel will execute orders within a maximum of 30 days. If this is not possible (because the ordered item is not in stock or no longer available), or there is a delay for other reasons, or an order cannot be executed or can only be partially executed, the consumer will receive a message within 1 month after placing the order and, in that case, has the right to cancel the order without costs or notice of default.
2.3 Woodmobiel's delivery obligation will be fulfilled, subject to proof to the contrary, as soon as the goods delivered by Woodmobiel have been offered to the customer once. In the case of home delivery, the carrier's report, containing the refusal of acceptance, serves as full proof of the offer to deliver.
2.4 All stated terms on the website are indicative. Therefore, no rights can be derived from the stated terms.
3. Prices
3.1 Prices will not be increased within the duration of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.
3.2 All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.
3.3 All prices stated on the site are in EUROS, including VAT in accordance with Dutch law.
4. Cooling-off period / right of withdrawal
4.1 If there is a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the customer has the right to return (part of) the delivered goods within a period of 14 days without giving reasons. This period starts when the ordered goods have been delivered. The customer is obliged, before proceeding to return the goods, to notify Woodmobiel in writing within 14 days of delivery. The return of the goods must be in the original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered, or damaged in any way by the customer, the right to dissolution lapses. Woodmobiel will ensure that the full purchase amount, excluding the calculated shipping costs, is refunded to the customer within 30 days after proper receipt of the return shipment. The return of the delivered goods is entirely at the expense and risk of the customer.
4.2 The right of dissolution, as described in the previous paragraph, only relates to the delivered goods and will in no case relate to services.
5. Data management
5.1 If you place an order with Woodmobiel, your data will be included in Woodmobiel's customer database. Woodmobiel adheres to the GDPR and will not provide your data to third parties. See our Privacy Policy.
5.2 Woodmobiel respects the privacy of users of the website and ensures confidential treatment of your personal data.
5.3 Woodmobiel uses a mailing list in some cases. Each mailing contains instructions on how to remove yourself from this list.
6. Warranty
6.1 Woodmobiel guarantees that the products it supplies meet the requirements of usability, reliability, and lifespan as reasonably intended by the parties to the purchase agreement, and thereby stands for the manufacturer's warranty of the product delivered to you.
6.2 Woodmobiel's warranty period corresponds to the manufacturer's warranty period. However, Woodmobiel is never responsible for the ultimate suitability of the goods for each individual application by the customer.
6.3 The customer is obliged to check the delivered goods immediately upon receipt. Any defects or incorrectly delivered goods must be reported to Woodmobiel in writing no later than 2 months after delivery.
6.4 If customer complaints are found to be justified by Woodmobiel, Woodmobiel will, at its discretion, replace the delivered goods free of charge or make a written arrangement with the customer regarding compensation, with the understanding that liability is always limited to a maximum of the invoice amount of the goods concerned.
6.5 Woodmobiel is not liable for damage caused by intent or gross negligence equivalent thereto by non-managerial personnel.
6.6 This warranty does not apply if: (A) the customer is in default towards Woodmobiel; (B) the customer has repaired or processed the delivered goods himself; (C) the delivered goods have been exposed to abnormal circumstances or have been handled contrary to the instructions; (D) the defectiveness is wholly or partly the result of regulations imposed by the government.
7. Offers
7.1 Offers are without obligation, unless otherwise stated in the offer.
7.2 In the event of acceptance of a non-binding offer by the buyer, Woodmobiel reserves the right to revoke or deviate from the offer within 3 working days after receipt.
7.3 Oral promises are only binding on Woodmobiel after they have been expressly confirmed in writing.
7.4 Offers do not automatically apply to backorders.
7.5 Woodmobiel cannot be held to its offer if the customer should have understood that the offer contained an obvious mistake or error.
8. Agreement
8.1 An agreement between Woodmobiel and a customer is concluded after an order has been assessed by Woodmobiel for feasibility.
8.2 Woodmobiel reserves the right to refuse orders without giving reasons, or to accept them only on the condition that shipment takes place after advance payment.
9. Images and specifications
9.1 All images, photos, drawings, and specifications (weights, dimensions, colors) on the Woodmobiel website are only approximate, indicative, and cannot give rise to compensation or dissolution of the agreement.
10. Force majeure
10.1 Woodmobiel is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.
10.2 Force majeure is understood to mean any strange cause and any circumstance that cannot reasonably be attributed to its risk: delays or non-performance by suppliers, disruptions in internet, electricity or e-mail, transport difficulties, strikes, government measures, illness of personnel, and defects in auxiliary or transport equipment.
10.3 In case of force majeure, Woodmobiel reserves the right to suspend its obligations or to dissolve the agreement in whole or in part. Woodmobiel is in no case obliged to pay any penalty or compensation.
11. Liability
11.1 Woodmobiel is not liable for damage caused to vehicles or other objects by incorrect use of the products. Before use, read the instructions on the packaging and in the user manual.
12. Retention of title
12.1 Ownership of all goods sold and delivered by Woodmobiel remains with Woodmobiel as long as the customer has not paid Woodmobiel's claims, all as intended in Article 3:92 of the Dutch Civil Code.
12.2 The goods delivered by Woodmobiel that fall under the retention of title may only be resold within the framework of normal business operations and may never be used as a means of payment.
12.3 The customer is not authorized to pledge or otherwise encumber the goods falling under the retention of title.
13. Applicable law / competent court
13.1 All agreements are governed by Dutch law.
13.2 Disputes arising from an agreement between Woodmobiel and the buyer, which cannot be resolved by mutual agreement, will be heard by the competent court within the district of Breda, unless Woodmobiel prefers to submit the dispute to the competent court of the buyer's place of residence, and with the exception of those disputes that fall within the jurisdiction of the subdistrict court.
